Health Check NZ – Terms and Conditions

Welcome to Health Check NZ (“we”, “our”, “us”). By booking, purchasing, or participating in any of our services, you (“client”, “employer”, “employee”, or “participant”) agree to the following Terms and Conditions.

Please read them carefully before proceeding.

1. Services Provided

Health Check NZ provides occupational health and wellbeing services including (but not limited to):

  • Pre-employment and periodic health assessments

  • Annual health and wellbeing checks

  • Vision, hearing, lung function, and fitness testing

  • Biological and environmental monitoring

  • Vaccinations and immunisation records

  • Health education, advisory, and referral services

All services are conducted by qualified health professionals in accordance with relevant New Zealand legislation and professional standards.
 

2. Bookings and Cancellations

  • Appointments must be confirmed in advance.

  • Cancellations or rescheduling require at least 24 hours’ notice.

  • Late cancellations or non-attendance may incur a fee of up to 100% of the service cost.

  • Group or on-site bookings require a minimum of 48 hours’ notice for changes to staff lists or schedules.


3. Payment Terms

  • Payment is due within 14 days of invoice unless otherwise agreed in writing.

  • Health Check NZ reserves the right to withhold results or reports until payment is received.

  • Overdue accounts may incur late payment fees and collection costs.


4. Consent and Confidentiality

  • All assessments are conducted with the individual’s informed consent.

  • Personal and health information is collected, stored, and used in accordance with the Health Information Privacy Code (2020) and Privacy Act (2020).

  • Results are shared only with the individual, and — with their written consent — the employer or referring organisation.

  • Aggregate or de-identified data may be used for reporting or quality improvement purposes.


5. Reporting and Fitness for Work

  • Reports are provided to employers with the candidate’s consent and will include a fitness-for-work outcome such as:

    • Fit for role

    • Fit with restrictions or recommendations

    • Temporarily unfit (requiring follow-up)

  • Health Check NZ does not make employment decisions. Fitness outcomes are recommendations based on clinical assessment.


6. Client Responsibilities

Clients are responsible for:

  • Ensuring employees are informed about the purpose of health checks

  • Providing accurate information relevant to the assessment

  • Maintaining a safe and private environment for on-site assessments

  • Complying with follow-up recommendations where required


7. Limitations of Service

  • Health Check NZ services are screening and advisory only.

  • They do not replace medical diagnosis or ongoing care from a general practitioner or specialist.

  • Participants are encouraged to seek independent medical advice for any findings or health concerns.


8. Liability

While all reasonable care is taken, Health Check NZ will not be liable for:

  • Any indirect, consequential, or incidental damages arising from the use of our services; or

  • Any actions taken or not taken by employers or employees based on our reports.
    Nothing in these Terms limits any rights or remedies available under New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986, where applicable.


9. Rescheduling and Force Majeure

Health Check NZ reserves the right to reschedule or cancel services due to circumstances beyond our control (e.g. illness, equipment failure, or natural events). In such cases, we will notify clients promptly and arrange an alternative date.


10. Intellectual Property

All content, materials, and reports produced by Health Check NZ remain our intellectual property and may not be reproduced or distributed without prior written consent.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
